Vantiv files lawsuit against DraftKings
Payment processor asks New York Supreme Court if it can continue to process payments for the daily fantasy sports operatorÂ
Vantiv has filed a lawsuit against DraftKings seeking clarity over whether it can legally continue to process payments for the daily fantasy sports (DFS) firm in New York. [private]
In its filing, Vantiv asked the New York Supreme Court to rule on the matter amid ongoing legal wranglings between DraftKings and the state attorney general (AG) over the legal status of DFS in the state.
According to the Cincinnati Business Journal, Vantiv said it had been âsubstantially impacted by the conflicting court decisionsâ which had created âsubstantial uncertaintyâ over how it should proceed.
New York Attorney General Eric Schneiderman took aim at FanDuel and DraftKings last year after ruling DFS met the definition of illegal gambling under state gaming law.
He issued cease and desist letters to both operators, who in turn filed lawsuits against the attorney generalâs office to enable them to continue operating in the state.
Schneiderman then applied for a temporary restraining order, which was awarded but immediately overturned by an appeals court which granted a temporary stay while legal proceedings rumbled on.
But on the turn of the New Year, Schneiderman amended his filing in a bid to force FanDuel and DraftKings to return all monies earned from players in New York.
Earlier this week FanDuel and DraftKings returned to court in a bid to extend their temporary stay, with a decision expected in the coming days.
