32Red-William Hill costs decision due in two weeks

William Hill Online will discover how much it will have to pay in legal costs to 32Red in two weeks a High Court judge has ruled, as the two-year trademark infringement case between the two operators continues.
Today’s session was expected to produce a result on the amount William Hill Online would pay in costs to online casino 32Red following its trademark dispute against the bookmaker after two years of legal proceedings.
32Red’s legal team asked the judge for an immediate decision however William Hill’s lawyers said it should be delayed. The presiding judge determined that rather than present his findings orally he would hand his summary down in writing in two weeks time.
32Red has asked the court for repayment of “significant legal costs” as well as an inquiry to take place to assess the extent of “damages or profits” arising from the alleged infringement. This will be heard following the written judgement to determine costs. William Hill Online will then disclose the global financial performance of 32Vegas between 1 January and 31 July 2009 as well as that of some of its other casino brands, including Joyland, that were allegedly fed players via the 32Vegas website.
32Red formally began proceedings against William Hill in August 2009 claiming that the use of a similar sounding name for an online casino was confusing for players, and that it has led to a loss of income with players opening accounts with 32Vegas believing they were gambling with 32Red.
The High Court of Justice in London ruled in favour of 32Red stating that William Hill’s use of 32Vegas and 32V had infringed 32Red’s European Community (EC) registered trademarks.
Yesterday, the same judge granted an injunction to 32Red preventing WHO from using the 32Vegas trademark “ rebranded 21Nova since August 2009 “ anywhere in the EU. William Hill Online must also publish yesterday’s judgement on some of its largest websites including its corporate website and Affiliates United, the 70,000 strong affiliate program for all of its brands.
